At the start of July 2005 OpenSkills changed from being an NSW association to become a company limited by guarantee. The reasons for this change were:
- Make OpenSkills more scalable. NSW associations have size limits.
- Is a better fit the the objectives of OpenSkills. NSW Associations may be dissolved if found to be engaged in securing financial gain for it's members. OpenSkills exists to promote members skills so they can gain financially through them.
- Give OpenSkills more financial flexibility. For example, the proposed committee pool would not be workable for an NSW association.
Company Limited By Guarantee
The operation of the association is goverened by the terms of the Charter of OpenSkills (called a constitution for companies limited by guarantee) and Australian federal Legislation:
A company limited by guarantee is a corporate entity registered with the Australian federal government.
OpenSkills was initially established as a New South Wales association.
